Provider” means the business organization (e.g., the business entity consisting of registered healthcare specialists, professionals and providers) using or accessing Deyenamics Services, and “Provider End User” means each individual employee or agent authorized by a specific Provider to access certain Deyenamics Services on the Provider’s behalf.

Initially, the Services are intended solely for Providers that are members of the DeyeNAMICS Alliance (each, a “Member”). However, we reserve the right, in our sole discretion, to authorize a Provider who is not a Member of the DeyeNAMICS Alliance to access or use some or all the Services (a “Non-Member”).

The practices and policies described in this Privacy Policy describe how we may collect, use and share information that we have obtained through your use of the DeyeNAMICS Services. Additional terms and conditions may apply to some Services offered on or through the Website (e.g., the payment processing application). Those terms and conditions can be found where the relevant Service is offered on the Website and are incorporated into this Privacy Policy by reference.

  • Enter into a DeyeNAMICS Alliance service agreement;
  • Upload information directly into the Website, including information about your employees and agents, including licensed practitioners;

Automatically Gathered Information.

Where permitted by applicable law, we automatically track certain information about you based upon your behavior while using our Services. This information is used to better understand and serve you by responding to your particular interests and needs.

Payment Information.

If you are a Provider purchasing a subscription to certain DeyeNAMICS Services through our Website, we use third-party payment processors (currently Stripe) to process your payments. These third parties will collect the information necessary to effectuate your transaction with us, such as credit/debit card number, security/CVV code, and expiration date. Our payment processors may handle your payment information in accordance with their own privacy policies. DeyeNAMICS does not have access to your full payment information.

Marketing and Communications.

From time to time your personal information, such as your name and email address, may be used to contact you with promotional materials, newsletters, marketing or other information that may be of interest to you based on your preferences. You may be contacted by the e-mail address you provide to us, subject to your right to opt in and opt out, as such rights may be available to you. You can withdraw your consent to receive any direct marketing communication from us by contacting privacy@deyenamics.com or following the unsubscribe instructions in our email communications.

Non-Personal Information.

We may collect and create de-identified and aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that DeyeNAMICS owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree DeyeNAMICS may use such information for any lawful purpose, including for analytics, research and development and other product and service improvement purposes.

HOW WE DISCLOSE YOUR INFORMATION

We may disclose aggregated Non-Personal Information about the users of our Services and information that does not identify any individual, without restriction. We may disclose certain limited personal information that we collect or you provide as further described in this privacy policy:

  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • With our related companies for research and development purposes, but only on an anonymized and de-identified basis.

THIRD PARTY INFORMATION COLLECTION:

When you use our Services and certain third-party sites linked from our Website, third parties may use automatic information collection technologies to collect information, including cookies, web beacons, and other storage technologies and location information about you or your device.

The information they collect may be associated with your personal information and location or they may collect information, about your online activities over time and across different websites, apps, and other online services. We do not control these third parties' tracking technologies or how they may be used.

AUTOMATED DECISION-MAKING:

Automated decision-making takes place when an electronic system uses personal information to make a decision about that person without any human intervention which produces legal effects concerning them or similarly significantly affects them. We do not currently use this type of automated decision-making in our business in relation to you. You will not be subject to decisions that will have a significant impact on you based solely on automated decision making unless we have a lawful basis for doing so and we have notified you. However, we do use certain internal anonymous tracking so that we can enhance the functionality of our products and Services and track our own analytics.

WHERE WE STORE YOUR INFORMATION:

Ensuring your personal information is kept and transferred securely is of the highest importance to us. We employ full end-to-end encryption technologies to secure all user specific data of Providers and Provider End Users. We hold your personal information on secure systems, based in the United States of America. To operate our business, sometimes we may send your personal information outside of your state, or country. Where we employ service providers, we have appropriate agreements in place to ensure your personal data is protected.

HOW WE PROTECT THE PRIVACY OF CHILDREN ONLINE:

Our Website is intended for use by businesses and is not intended for minors or children under 18 years of age. No part of our Services are designed or intended to attract anyone under the age of 18. If you are a minor under the age of 18, you are not permitted to use the Services.

INFORMATION RETENTION:

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:
